Effective
GoshenPay is software that helps Canadian churches receive, record, and receipt gifts. When you give through a church's giving page, your gift goes to that church — not to us. These terms explain what you can expect from us, what we expect from you, and how responsibilities are divided between GoshenPay, the church, and Stripe.
1. Who these terms apply to
These Terms of Service (the “Terms”) are an agreement between you and GoshenPay (“we”, “us”). They apply to everyone who uses the GoshenPay platform (the “Service”), including:
- Donors — people who give to a church through a giving page we host or who hold a giving account with us;
- Churches — the congregations and religious charities that use the Service to receive and manage gifts; and
- Church staff — the people a church authorizes to act in its workspace.
By using the Service you agree to these Terms and to our Privacy Policy. A person who creates a church on the Service or accepts a staff invitation agrees to these Terms on the church's behalf and confirms they are authorized to do so. If you do not agree, do not use the Service.
2. The church is the recipient
Every gift made through the Service is a gift to the church whose page you are giving on. The church is the recipient of your gift, the merchant of record for the payment, and — where it is a registered charity — the legal issuer of any official donation receipt. GoshenPay provides the software; we are not a charity, we are not a party to your gift, and we do not decide how the church uses it.
Digital gifts are charged directly to the church's own Stripe account and settled by Stripe to the church's bank account. Gift funds do not pass through a GoshenPay bank account.
3. Payments and Stripe
Online payments are processed by Stripe. When you pay, you are taken to a Stripe-hosted checkout and your card or bank details are collected by Stripe under its own terms and privacy policy. GoshenPay never receives or stores your full card number, bank credentials, or security codes.
Churches use Stripe through Stripe Connect and are bound by Stripe's Connected Account Agreement. Stripe's processing fees are charged to the church by Stripe and shown to the church separately from our fees.
A church may offer you the option to add an amount to your gift to help cover processing costs. That amount is optional, is shown to you before you pay, and forms part of your gift to the church.
4. Recurring gifts
When you set up a recurring gift you authorize the church, through Stripe, to charge your chosen payment method for the amount and at the frequency you selected — weekly, every two weeks, monthly, quarterly, or annually — starting on the date shown at checkout and continuing until you cancel or the gift reaches an end date you set.
- You can change the amount, fund, frequency, or end date, update your payment method, or cancel at any time from your giving account. Changes apply to your next gift; we do not prorate.
- If a payment fails, Stripe may retry it and we will email you a secure link to update your payment method. A gift is only recorded once payment succeeds.
- Cancelling stops future charges. It does not reverse gifts already made.
5. Refunds and disputes
Gifts are voluntary contributions to the church. If you gave in error or need to request a refund, contact the church directly; refund decisions belong to the church, subject to its own policies and the law. When a church approves a refund, it is issued through Stripe to the original payment method and reflected in your giving history. If you dispute a charge with your bank instead, the church will see the dispute and the gift will no longer count toward any donation receipt.
6. Donation receipts
Official donation receipts for income tax purposes are issued by the church under its own Canada Revenue Agency registration and authority. GoshenPay prepares receipts from the church's records on the church's instruction; we do not issue receipts in our own name and we do not provide tax advice.
- A receipt can only be prepared for a gift the church has matched to you, and only if the church holds your legal name and mailing address. Anonymous gifts cannot be receipted to an individual.
- Churches are responsible for the accuracy of their registration number, legal name, address, and authorized signature, and for deciding which gifts are eligible.
- Issued receipts are never edited. Corrections are made by voiding the original and issuing a replacement that refers to it.
7. Accounts and security
You can give without an account. If you create a giving account, or a church invites you as staff, you agree to provide accurate information, to keep your sign-in credentials and email inbox secure, and to tell us promptly at support@goshenpay.com if you believe your account has been accessed without permission. You are responsible for activity that happens under your account.
Church staff act on the church's behalf. Each church is responsible for who it invites, the roles it assigns, and the actions its staff take in the workspace, including counting, approving, adjusting, and receipting gifts.
8. Church responsibilities
By using the Service, a church confirms that it:
- is a bona fide religious organization authorized to accept the gifts it receives through the Service, and is a registered charity or other qualified donee if it issues official donation receipts;
- provides accurate legal, banking, and contact information to us and to Stripe, and keeps it current;
- is responsible for the content of its giving page and for any promises it makes to donors about how gifts will be used;
- complies with Stripe's terms, the Income Tax Act and CRA guidance on receipting and record-keeping, privacy law, and all other applicable law; and
- uses the Service's controls — separation of duties, approvals, adjustments, and audit history — as intended, and does not attempt to alter approved financial records outside them.
9. Fees
Donors are not charged a fee by GoshenPay for giving. Churches pay the platform fee disclosed to them when they onboard, which is collected through Stripe Connect from digital gifts and is shown to the church separately from Stripe's processing fees. We may change our fees with at least 30 days' notice to the church.
10. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or to launder money;
- give, or record gifts, using payment methods or identities you are not authorized to use;
- access another donor's or another church's information, or attempt to bypass tenant boundaries, authentication, or role permissions;
- probe, scrape, overload, or interfere with the Service or its infrastructure; or
- misrepresent a church, GoshenPay, or Stripe to anyone.
We may suspend or restrict access to protect donors, churches, the Service, or our obligations to Stripe.
11. Your information
How we collect, use, and protect personal information is described in our Privacy Policy, which forms part of these Terms. In short: your giving account and cross-church history are private to you; each church sees only the gifts made to it; and churches are responsible for how they handle the donor information they receive.
12. Our property and yours
The Service, including its software, design, and documentation, is owned by GoshenPay and its licensors. We grant churches and donors a limited, revocable, non-exclusive right to use it under these Terms. Churches keep ownership of their records and donor data, and donors keep ownership of their own information; you grant us the rights needed to operate the Service for you.
13. Exports and leaving
A church may export its contribution, donor, batch, deposit, receipt, and audit records at any time and may stop using the Service at any time. Donors may request a copy of their giving history. After a church or donor leaves, we retain records for as long as the law requires — including records a registered charity must keep under the Income Tax Act — and as described in the Privacy Policy.
14. Disclaimers
The Service is provided “as is” and “as available”. We work to keep giving pages available and records accurate, but we do not guarantee uninterrupted operation, and we rely on Stripe, email providers, and other third parties we do not control. Nothing in the Service is legal, tax, or accounting advice; churches remain responsible for their own compliance and for reviewing receipts, reports, and exports before relying on them.
15. Limitation of liability
To the fullest extent permitted by law, GoshenPay is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost gifts, revenue, or data, arising from your use of the Service. Our total liability to a church for all claims in any twelve-month period is limited to the fees that church paid us in that period; our total liability to a donor is limited to one hundred Canadian dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16. Changes to these terms
We may update these Terms from time to time. When we make a material change we will post the new version here with a new effective date and, for churches, give reasonable notice by email. Continuing to use the Service after a change takes effect means you accept it.
17. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute that cannot be resolved informally will be brought in the courts of Ontario, and you agree to their jurisdiction.
